These Terms of Service (“Terms”) govern your access to and use of the Baby Daybook mobile application (“App”) and associated services provided by Baltapis UAB (“Company,” “we,” “us,” or “our”), a company registered in Lithuania.
By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not access or use the App.
1. Use of the App
1.1 Eligibility
You must be at least 13 years old, or the legal age of majority in your jurisdiction, to use the App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
1.2 License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms and applicable laws.
2. User Accounts
Some features of the App require account registration (e.g., data sync, caregiver sharing). You agree to:
- Provide accurate, complete, and current information
- Maintain the confidentiality of your login credentials
- Be responsible for all activities that occur under your account
We reserve the right to suspend or terminate your account if we suspect unauthorized use or violation of these Terms.
3. Subscriptions and Payments
Certain features of the App are available only to subscribers of Baby Daybook Premium. If you choose to subscribe:
- Subscription Plans are billed through the Apple App Store or Google Play Store, depending on your device. The subscription is offered on a recurring basis (e.g., monthly or annually), and will automatically renew unless canceled at least 24 hours before the end of the current billing period.
- You are responsible for managing and canceling your subscription through your respective app store account settings.
- Free Trial: We may offer a one-time free trial period for new users to try Baby Daybook Premium. The free trial is only available once per Apple ID or Google account. At the end of the free trial period, your subscription will automatically convert to a paid plan unless you cancel before the trial ends. You will not be eligible for another free trial under the same account, even if you uninstall and reinstall the App or create a new profile.
- We reserve the right to change the pricing, features, or availability of any subscription plan, and will provide notice where required by law.
All payments, billing, cancellations, and refund requests are handled directly by the App Store or Google Play. We do not process or issue refunds ourselves.
4. User Content
You may submit content such as baby activity logs, notes, photo and video attachments (“User Content”). You retain ownership of your content, but you grant us a worldwide, royalty-free, non-exclusive license to use, store, host, and process it solely for the purpose of providing and improving the App.
You are solely responsible for your User Content and agree not to upload content that is:
- Illegal, harmful, abusive, or infringing on others’ rights
- In violation of privacy or intellectual property laws
- Obscene or inappropriate
We reserve the right (but not the obligation) to remove any content that violates these Terms.
5. Data and Privacy
By using the App, you agree to the collection and use of information as described in our Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.
6. Intellectual Property
All intellectual property rights in the App, including but not limited to its design, features, graphics, logos, and source code, are owned by or licensed to Baltapis UAB. Except for the limited license granted in Section 1.2, nothing in these Terms grants you rights to our intellectual property.
7. Prohibited Conduct
You agree not to:
- Use the App for any unlawful or unauthorized purpose
- Reverse engineer, modify, or tamper with the App
- Attempt to gain unauthorized access to systems or user accounts
- Transmit viruses, malware, or harmful code
- Abuse, harass, or impersonate other users
8. Termination
We may suspend or terminate your access to the App at any time, without notice, if you breach these Terms or if your use poses a legal or security risk.
Upon termination:
- Your license to use the App ends immediately
- We may delete your account and associated data, subject to our Privacy Policy
9. Disclaimers
The App is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee:
- That the App will be error-free or uninterrupted
- The accuracy or reliability of logs or data entered
- That the App is suitable for medical diagnosis or treatment
- That translations in the App are accurate or error-free — some content may be translated using automated systems or artificial intelligence (AI), and we make no guarantees regarding the accuracy, completeness, or appropriateness of translated content
The App is intended for informational purposes only and does not constitute medical advice. Always consult a qualified healthcare provider for any medical concerns.
10. Limitation of Liability
To the fullest extent permitted by law, Baltapis UAB and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:
- Your use or inability to use the App
- Unauthorized access to or use of your data
- Any interruption or termination of the App
Our total liability shall not exceed the amount you paid for the App in the past 12 months.
11. Modifications
We reserve the right to modify these Terms at any time. Continued use of the App after such changes constitutes your acceptance of the updated Terms.
12. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the Republic of Lithuania, without regard to its conflict of laws principles.
If any dispute arises out of or in connection with these Terms, the parties shall first attempt to resolve the matter amicably. If resolution cannot be reached, the dispute shall be submitted to the competent courts in Lithuania.
